F. Dirrigl made a motion to seat R. Peloquin as an alternate. K. Metzler seconded the motion, both were in favor, thus R. Peloquin was seated as a voting member.
New Business
1. W2006-34- Application for Selective Timber Harvest on property on Luchon Road (Map 18, Lot 8B of 30 acres) Owner/Applicant: Winthrop & Elizabeth Merriam; Applicant: Hull Forest Products, Inc. Attn: Michael J. Bartlett (Received 7/24/06, Decision by 9/25/06)
Mike Bartlett was present to discuss the changes to his original application. He stated that Gary Jones walked the property with him and they decided that he would not cut the trees that could possibly fall into the vernal pool.
F. Dirrigl made a motion to approve W2006-34- Application for Selective Timber Harvest on property on Luchon Road with the amendment submitted on 9-11-06 stating that they would not cut trees near the vernal pool and construct crossings as recommended by Gary Jones. R. Peloquin seconded the motion. All in favor, thus the motion carries.
2. W2006-35-Application for construction of common driveway within upland review area on property at 49 & 53 Navratil Road (Map 14, Lots 41 & 41A) Owner/Applicant Patriot Land Development, LLC (Received 7/24/06, Decision by 9/25/06)
Ronald Polland was present to request a continuance from the commission. He stated he is still waiting to hear back from the health district and he also stated that he was informed that according the section four of the IWWC regulations that his attorney said he does not need to submit an application. The commission said that they did not think that this was true and granted him a continuance.
3. W2006-36 – Application for zone change only, no site development-Requesting No Jurisdiction on property at 76 Turnpike Road (Map 45, Lots 24 &25) Owner; Irene Klei; Applicant Herbert Klei (Received 9/11/06; Decision by 11/13/06)
Paul Charette and Mr. Klei were present to discuss the application. F. Dirrigl recused himself due to being under contract with a party involved with the application. Mr. Klei stated that he owns this property and wants to change the current zoning to add industrial area in order to straighten out the boundary lines. He stated that there is no proposed activity at this time. He also stated that he is asking for No Jurisdiction. K. Metzler asked if there is any wet land activity is the property. Mr. Klei said that he thinks there is. K. Metzler reminded the applicant that if this was granted that he would still need to come back to the commission for any approval for building. Mr. Klei stated that he wanted the property all zone the same so if there are wetland issues then
they can all be addressed at the same time.
Due to a quorum not being met, no decision could be made; application was continued to the next meeting.
4. W2006-41- Application to construct a single family home, driveway and septic in the Upland Review Area at 57 Parker Road (Map 16, Lot 15-0B, Zone R80) Owner/Applicant: Norman Wilson (Received 9/11/06; Public Hearing or Decision by 11/13/06)
The applicant stated that the property is an existing parcel which contains 8.26 acres. He stated that there is no proposed activity in the wet lands but there is in the Upland Review Area. He stated that there is an intermittent watercourse on the property as well as wetlands on the neighboring property. He stated that these areas have been flagged by a soil scientist.
K. Metzler asked that Gary review the property.

7. W2006-44-Application for Selection Timber on property on Krivanec Road (Map 22; Lot 13A, of 5 acres, R80 Zone) Owner: Paul Grimason; Applicant: Hull Forest Products, Inc. Attn: Michael J. Bartlett (Received 9/11/06, Decision by 11/13/06)
Mike Bartlett asked to address all three Timber Harvests together as they will be harvested as one large harvest. The commission said that would be fine.
S. Yorgensen asked if there were any conservation easements on any of the properties. Mr. Bartlett said that he did not think so.
Mr. Bartlett said that all the tress would be harvested under his supervision and on days when he could not be present at the properties there would be a certified forest harvester there.
Mr. Bartlett stated that the existing culvert will have the most crossings. He stated that on existing roads from previous harvests they will use log corduroy or if there is water present they will use portable bridges to protect the integrity of the crossings.
Mr. Bartlett stated the property on Krivanec Road there are some plants that they will need to only cut above and below them so not to disturb the growth.
K. Metzler asked if G. Jones walked all of the crossings with Mr. Berlet. Mr. Bartlett said that he had.
S. Yorgensen asked how close they will be cutting the wetlands and the brook. Mr. Bartlett said that they will cut up to 50 feet of the brook and the trees are only marked up to the wetland area.
K. Metzler stated that the commission could not act on the application tonight as it was received today.
K. Metzler said that he would like further clarification from G. Jones on his memo. S. Yorgensen asked how long the harvest should take. Mr. Bartlett said approximately three months. S. Yorgensen also asked Mr. Bartlett to research if any of the properties had conservation easements.
8. W2006-45-Application for Selection Timber on property on Burma Road (Map 31; Lot 14 of 50 acres) Owner E. John Aberle; Applicant: Hull Forest Products, Inc. Attn: Michael J. Bartlett (Received 9/11/06, Decision by 11/13/06)
Mr. Bartlett said that this will be a 50 acre harvest and that there are no tress in the wetland area. He stated that the skid trails have been marked and that they are using the ones left from a previous harvest in 1980. He stated that there are some steep slopes that have been flagged and water bars will be placed there. Mr. Bartlett said that he tried to minimize the amount of crossings that would be needed, which meant he required longer skid trails. Mr. Bartlett also stated that they will be entering and exiting the property in Ashford.
K. Metzler asked staff if they knew of any issues with the property. He stated that this application would be tabled to the next meeting.
Pre-Application
Gardner & Peterson to discuss two proposed lots on Lohse Road.
Mark Peterson was present to discuss the changes he has made to a previous application. He stated that his original application was denied and he would like some input before he comes back to present it again. Mr. Peterson showed where he added an erosion control blanket and addressed previous concerns about run off and sediment. He discussed the use of a common driveway for the least amount of disturbance to the wetlands. Mr. Peterson stated that he moved the location of the septic tank to the north side of the property which allowed for an erosion control blanket.
Mr. Peterson stated that he did receive approval from the Health District but is waiting to hear back from the town engineer to see what his thoughts and concerns regarding the property are. He also stated that they will have an inspector on site during construction to monitor what is going on.
Mr. Peterson asked for comments from the commission. K. Metzler asked for copies of the plans so the commission could take some time to look it over.

K. Metzler questioned as to why the road is still not totally complete. S. Yorgensen stated that no one has requested that the town approve the road. She stated that she will make sure that the post office and public works know that the road is not yet a town road.
K. Metzler stated that the commission should have a site walk to see what is happening to the area.
2. File #2003-49- Notice of Violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.
